The terms that govern use of profitlead.agency and our pay-per-lead services.
These Terms of Service ("Terms") govern your use of the website at profitlead.agency (the "Site") and the lead generation services (the "Services") provided by Fullstack Agency LLC, doing business as Profit Lead Agency ("Profit Lead Agency," "we," "us," or "our"), located at 5900 Balcones Dr, Ste-100, Austin, Texas, 78731, USA. By using the Site or engaging our Services, you agree to these Terms. If you do not agree, please do not use the Site or Services.
Profit Lead Agency generates exclusive, qualified kitchen remodeling leads for local businesses in the United States on a pay-per-lead basis. We design, fund, and operate advertising campaigns, landing pages, and qualification systems, and deliver qualified leads to clients in real time. Specific volumes, territories, qualification criteria, and per-lead pricing are set out in the individual agreement or order confirmed with each client (the "Client Agreement"). If these Terms conflict with a Client Agreement, the Client Agreement controls.
The Site and Services are intended for business use by persons aged 18 or older who are authorized to act on behalf of their business. By engaging the Services you represent that your business is properly licensed and insured to perform the remodeling work for which leads are supplied, where such licensing is required.
Clients pay a fixed price per qualified lead delivered, as agreed in the Client Agreement. There are no retainers or ad-spend management fees unless separately agreed in writing. Invoices are issued by Fullstack Agency LLC (DBA Profit Lead Agency) and are payable per the terms stated on the invoice. We may suspend lead delivery for accounts with overdue balances.
A lead is "qualified" when it meets the criteria agreed in the Client Agreement (for example: located within the agreed service area, valid contact details, and expressed interest in kitchen remodeling work). If a delivered lead does not meet the agreed criteria — for example, invalid contact details or a location outside your territory — we will replace it at no charge upon notice within the window stated in the Client Agreement. Lead replacement is the sole and exclusive remedy for non-qualifying leads. Leads are not eligible for replacement merely because they do not result in a sale.
Each qualified lead is delivered exclusively to one client and is not simultaneously sold, auctioned, or redistributed to competing businesses.
While we qualify every lead before delivery, we do not and cannot guarantee that any lead will result in an appointment, sale, or any particular revenue outcome. Any figures on the Site describing performance are illustrative and do not constitute a promise of results for any individual client.
The Site, including its design, text, graphics, and branding, is owned by or licensed to Fullstack Agency LLC and is protected by intellectual property laws. Campaign assets, landing pages, and qualification systems we build remain our property unless otherwise agreed in writing. You may not copy, reproduce, or create derivative works from the Site or our materials without our prior written consent.
Each party agrees to keep confidential any non-public business information received from the other in connection with the Services and to use it only for purposes of the engagement.
Except as expressly stated in these Terms or a Client Agreement, the Site and Services are provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by law, Fullstack Agency LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues, arising out of or related to the Site or Services. Our total aggregate liability for any claim shall not exceed the amounts paid by you for the Services in the three (3) months preceding the event giving rise to the claim.
You agree to indemnify and hold harmless Fullstack Agency LLC and its officers, employees, and agents from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the leads or Services in violation of these Terms or applicable law, including any claims arising from your communications with leads.
Either party may terminate the Services as provided in the Client Agreement. We may suspend or terminate access to the Site or Services immediately for material breach of these Terms. Sections that by their nature should survive termination (including payment obligations, confidentiality, disclaimers, limitation of liability, and indemnification) will survive.
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Services shall be brought exclusively in the state or federal courts located in Travis County, Texas, and the parties consent to their jurisdiction.
We may update these Terms from time to time. The "Effective date" above reflects the latest revision. Continued use of the Site or Services after changes take effect constitutes acceptance of the updated Terms.
